Did your brother sign the birth certificate?  If he didn&#039;t then welfare should have began a child support order, which then would need a paternity test to prove he is the father.  If he did sign it, then he needs to go to the court and tell them that at the time he signed it, he thought he was the father, but now the mother told him shes not sure.  Because legally, if he signs the birth certificate, then he is declaring hes the father and agrees to all responsibility.  The only way out is if he is proven not to be the father somehow, or if after signingit, he learns he may not be the father.  The court will do a paternity test and in the process he can legally get visitation or even joint custody if he wishes.

Your brother can get a DNA paternity test done by a private lab. He has the option to do it with or without the mother involved.

I don&#039;t know exactly what legal actions he can take, it depends if hes giving her any money!

If he&#039;s giving her money then I would stop and tell her NO MORE until she has a test done. 

The only thing is if it is your brothers, &amp; if shes mean she&#039;ll probably go off welfare and make him pay child support now that she has evidence. 

Hopefully everything will work out soon cuz that babies gonna start wondering whos his daddy?</description>

I think he can go to the department of human services if she is getting welfare. They (DHS) would want to know because then the father would be responsible for paying for the child and not the state. He should look into that avenue.</description>
